1. About us
This website is operated by MERBACO LTD, trading as Merbaco Kitchen, a company registered in England and Wales under company number 17254419, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Email: hello@merbacokitchen.com. These terms apply to all orders placed on this website by consumers in the United Kingdom.
2. Our products
Our recipe card boxes contain printed recipe cards; each card includes a QR code linking to an online video. Product images are for illustration – the product you receive may vary slightly. Recipes are provided for guidance. Please check all ingredients for allergens and follow food safety and kitchen safety practices when cooking; you are responsible for the ingredients and equipment you use. Online videos require an internet connection and a compatible device.
3. Orders and contract
When you place an order you will receive an email acknowledging it. This is not an acceptance. The contract between us is formed when we send you an email confirming that your order has been dispatched. We may decline an order, for example if the product is unavailable or there is an obvious pricing error; if so we will tell you and refund any payment in full.
4. Prices and payment
All prices are shown in pounds sterling (GBP). Delivery charges are shown at checkout before you pay. Payment is taken when you place your order.
5. Delivery
We deliver within the UK only. Delivery options, costs and estimated times are set out in our Shipping Policy. Risk in the goods passes to you on delivery; ownership passes once we have received full payment.
6. Cancellations and returns
You have a legal right to cancel within 14 days of receiving your goods. Full details are in our Refund Policy.
7. Faulty goods and your legal rights
We are under a legal duty to supply goods that are in conformity with this contract. Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. See our Refund Policy for how to report a faulty item.
8. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaching these terms or failing to use reasonable care and skill. We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights. We supply products for domestic and private use only and are not liable for any business losses.
9. Intellectual property
All content on this website and in our products – including illustrations, text, recipe cards and videos – belongs to MERBACO LTD or its licensors. You may use it for your own personal, non-commercial use only.
10. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control. If such an event affects your order, we will contact you and you may cancel and receive a refund for any products not received.
11. Changes to these terms
We may update these terms from time to time. The version in force when you place your order will apply to that order.
12. Law and disputes
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
